DETROIT — A Detroit area physician faces federal charges for allegedly performing female genital mutilation on multiple 6- to 7-year-old girls as part of a religious and cultural practice at a Michigan medical clinic, in what is believed to be the first federal prosecution of its kind in the U.S.

According to a criminal complaint filed in U.S. District Court in Detroit on Wednesday, the victims' parents brought them to the clinic in Livonia, Mich., from Minnesota — pretending it was a "special" girls trip — and later told the girls to keep what was happening a secret.

The accused is Jumana Nagarwala, 44, of Northville, Mich., an emergency room doctor at Henry Ford Hospital, who — according to the federal government — is a member of a religious and cultural community that practices female genital mutilation on young girls and women to curb their sexuality and make sex painful. In the U.S., female genital mutilation qualifies as a criminal sexual act as the intent of the procedure is considered to abuse, humiliate, harass or degrade.

Nagarwala did not perform the mutilation at the hospital, the government alleges, but rather at the Livonia clinic.

The U.S. Attorneys Office says this is the first such criminal case in the country, with prosecutors relying on a law that criminalizes the practice of female genital mutilation, which is punishable by up to five years in prison. The doctor, however, could get 10 years to life in prison for another crime she was charged with: Transportation of an individual with intent to engage in criminal sexual activity.

According to the complaint in U.S. District Court in Detroit, which was unsealed Thursday, phone call records and surveillance video show that in February, two Minnesota girls and their parents went to the Detroit area for what was portrayed as a "special" girls trip. They stayed at a hotel and ended up visiting Nagarwala, thinking they were seeing the doctor because their "tummies hurt." Instead, the complaint said, the girls had their genitalia altered or removed.

One of the victims said "her parents told her that the procedure is a secret and that she is not supposed to talk about it," FBI agent Kevin Swanson wrote in his affidavit filed Wednesday in U.S. District Court.

According to the affidavit, the FBI's investigation has identified other children who may have been victimized by Nagarwala between 2005 and 2007.

"Female genital mutilation constitutes a particularly brutal form of violence against women and girls. It is also a serious federal felony in the United States. The practice has no place in modern society and those who perform (female genital mutilation) on minors will be held accountable under federal law," said acting U.S. Attorney Daniel Lemisch.

Especially egregious, authorities said, is that the accused is a doctor who is supposed to help and heal people.

"Despite her oath to care for her patients, Dr. Nagarwala is alleged to have performed horrifying acts of brutality on the most vulnerable victims," acting Assistant Attorney General Kenneth Blanco of the U.S. Justice Department said Thursday, vowing the Justice Department "is committed to stopping female genital mutilation in this country."

Authorities spoke with Nagarwala on Tuesday. She volunteered to be interviewed by a Homeland Security agent and Michigan child protective services personnel, the complaint said. During her interview, she said she is aware female genital mutilation is illegal in the U.S., but denied ever performing it on any minor children. She also said she had no knowledge of the procedure being performed on anyone in her cultural community.

Nagarwala is due in federal court in Detroit on Thursday for an initial appearance.

Nagarwala earned her medical degree from Johns Hopkins University in 1998, according to the Henry Ford Health Systems website. Her bio lists the languages she speaks as English and Gujarati, which is spoken by the Gujaratis, who hail from the western India state of Gujarat, the same ethnic area that Mahatma Gandhi came from.

It is unclear what led authorities to the doctor.

Phone records showed that the doctor and two families from Minnesota were in regular communication in February. On Feb. 3, the FBI would learn, two young girls from Minnesota and their parents stayed at a Farmington Hills, Mich., hotel and went to see a doctor at a clinic in Livonia because "our tummies hurt," one of the girls told an FBI forensic expert.

While at the doctor's office, a procedure "to get the germs out" of her was performed, the complaint stated. That procedure was female genital mutilation. The girl was given a pad to wear, and was told "not to talk about the procedure," the complaint said. A second girl told a similar story, telling the investigator that "her parents told her that the procedure is a secret and that she is not supposed to talk about it."

A medical doctor in Minnesota examined both girls this week, pursuant to a search warrant. The doctor told the FBI both girls' genitals were not normal in appearance and had been "altered or removed."

The parents of one of the girls told Minnesota Child Protective Services personnel and a federal agent that they took the girl to Detroit to see Nagarwala for a "cleansing" of extra skin, the complaint said.

According to the World Health Organization, female genital mutilation is an internationally recognized violation of human rights of girls and women. The organization, citing a 2016 UNICEF report, said more than 200 million girls and women alive have been cut in 30 countries in Africa, the Middle East and Asia, where female genital mutilation is concentrated.
I was thinking that Bohra Muslims are the most forward Muslims. After so called Dr. Nagarwala, not any more though.....

The attorney for a Detroit-area doctor accused of mutilating the genitals of young girls acknowledges that her client performed the procedure, but she says it was part of a religious practice.

The revelation came during a detention hearing on Monday, a few days after Jumana Nagarwala was charged in what authorities say is the first case of its kind in the country. Shannon Smith said in federal court in Michigan that her client removed the girls’ genital membrane as part of a custom practiced by the Dawoodi Bohra, a small sect of Indian Muslims of which Nagarwala is a part, the Detroit Free-Press reported.

Nagarwala, 44, of Northville, Mich., was charged last week with female genital mutilation, transportation with intent to engage in criminal sexual activity and making a false statement to a federal officer. Federal investigators say she performed genital mutilations on two 7-year-old girls at a medical clinic in Livonia, just outside Detroit. The procedures were performed secretly after business hours and without medical billing records, according to a criminal complaint.

Nagarwala, an emergency room doctor for the Henry Ford Health System in Detroit, initially denied performing genital mutilation on children. She told investigators earlier this month that she’s aware the procedure is illegal in the United States.

During the hearing, a federal judge decided to keep Nagarwala incarcerated while the criminal case is pending.

“I think there’s clear and convincing evidence that your client poses a danger to the community,” U.S. Magistrate Judge Mona Majzoub said, according to the Detroit Free-Press.

According to the complaint, the girls’ family traveled last February from Minnesota to Michigan, where they were brought to see Nagarwala. One of the girls told investigators that she was taken to Michigan for a “special” girls’ trip. In describing the procedure, she said it was “to get the germs out.” The other girl said she screamed after a painful “shot.” Both girls said they were told to not talk about what happened.

Nagarwala is one of two Michigan doctors arrested in connection to genital mutilation this past week.

Authorities arrested another doctor, Fakhruddin Attar, 53, and his wife, Farida Attar, 50, both of Livonia, Mich., on Friday. Federal prosecutors say Fakhruddin Attar owns the clinic where Nagarwala performed genital mutilations, while his wife, the clinic’s office manager, assisted during the procedures.

The Attars have been charged with conspiring to perform female genital mutilations on minor girls.

Fakhruddin Attar told investigators that Nagarwala saw patients, girls between ages 6 and 9, at his clinic about five to six times a year, according to a criminal complaint unsealed Friday. He said Nagarwala saw the patients for problems with their genitals, including treatment of rashes. The visits were usually after clinic hours, on Friday evenings or Saturdays, he told investigators.

His wife, Farida, comforted the girls during the examinations by holding their hands, Fakhruddin Attar told investigators.

Investigators say they believe that Nagarwala mutilated the genitals of several other children at Attar’s clinic between 2005 and 2017.

Federal child forensic interviewers have talked to several Michigan children who said that Nagarwala had performed genital mutilation on them. Two parents said the doctor performed the procedure on their daughter, while others denied knowing anything about it, according to the complaint.

Investigators also say that Nagarwala and the Attars are members of the same religious community.

Female genital mutilation remains common among the Dawoodi Bohras who mainly live in India. But some members of the religious community have come out to rebel against the practice, according to a report by the Los Angeles Times.

Two online petitions, started by a group called Speak out on FGM, is seeking to end female genital mutilation in India and has so far garnered a total of more than 200,000 signatures. The practice is known as “khatna” in the Dawoodi Bohra community.

One of the petitions’ writers argued that the practice, held in secret and usually without consent, is more of a cultural one, and “has nothing to do with religion.”

“The Dawoodi Bohras are amongst the most educated in India, yet we are also the only Muslim community in India to practice FGM,” the writer wrote. “Most of us are too scared to speak out publicly. We fear ostracization, social boycott and exclusion of our families from the rest of the community by our religious clergy if we object to the continuation of this practice.”

Female genital mutilation — or removing all or part of a female’s genital for nonmedical reasons — is considered a human rights violation, though it is practiced extensively in some African countries and areas of the Middle East, according to UNICEF. A June 2016 report from the Government Accountability Office found that increased immigration from countries where it is practiced had brought it to the United States, and the Centers for Disease Control and Prevention estimated that in 2012, 513,000 women and girls here were “at risk of or had been subjected” to it.

The report also found that while female genital mutilation was a crime under federal and many state laws, there were few investigations or prosecutions stemming from it — because of underreporting and other problems, The Washington Post’s Matt Zapotosky reported. The report said the FBI had two investigations from 1997 to 2015, one which resulted in a prosecution on other charges. Department of Justice officials indicated to the Government Accountability Office they were aware of two state prosecutions involving the practice.
May be she got her medical degree on Government's quota system. Some so called religious minorities easily acquired degree certificates when there was a minority vote centric Congress reign at the centre in India!

In US FGM is federal crime but its legal in Muslim dominated state Like Michigan.

This doctor comes from Gujarat and medical degree is valid. In order to practice in US she did pass all exams. Her clientele is mostly some Sunni vohra of Gujarat and Somali and other North African women. No one should shed tears for them!They do it knowingly and even some adult muslimmahs from those places get it done in Singapore and other medically advanced countries. It's medicaly safe and they tell us sexual pleasure increases and they can now bear more children.What more you want? Best way to fight them is to ridicule them, support them, send some money !

How does it work, having a federal crime that's allowed in a state - would they have to go over the state line into another state and do it before they were charged? What about taking children the other way - would that be allowed?

If Feds decide to go after them, they can charge them for federal violation.State of Michigan will be shamed if they try to defend FGM right of Muslims.

Same thing apples to Marjuana laws of Colorado. Feds under Trump can charge but on other hand conservatives give priority to state laws and try to protect state laws. If it concerns terrorism and big crimes Feds go after them and can win the case.In that case no one can hide behind antiquated state laws.

FGM is indeed not Islamic practice, since fitrah is hygiene/cleanliness (not elimination of desire) :

The hadeeth narrated by al-Bukhaari (5889) and Muslim (257) from Abu Hurayrah (may Allaah be pleased with him), that the Prophet (peace and blessings of Allah be upon him) said: "The fitrah is five things – or five things are part of the fitrah – circumcision, shaving the pubes, cutting the nails, plucking the armpit hairs, and trimming the moustache."

This hadeeth includes circumcision of both males and females.

Muslim (349) narrated that ‘Aa’ishah (may Allaah be pleased with her) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “When a man sits between the four parts (arms and legs of his wife) and the two circumcised parts meet, then ghusl/bath is obligatory.”

The Prophet (peace and blessings of Allaah be upon him) mentioned the two circumcised parts, i.e., the circumcised part of the husband and the circumcised part of the wife, which indicates that a woman may be circumcised just like a man.

QS. 2:222. And they ask you about menstruation. Say, "It is harm, so keep away from wives during menstruation. And do not approach them until they are pure. And when they have purified themselves, then come to them from where Allah has ordained for you. Indeed, Allah loves those who are constantly repentant and loves those who purify themselves."

The Messenger of Allah said: “Cleanliness is half the faith.” [Sahih Muslim]

Here Garudman is quite honest and admit that female circumcision was widely practiced during life of Prophet.

Prophet didn't banned it . This is the reason numerous Islamic communities practice all over the world.

I say let them practice as it makes Muslimmahs more fertile and more sexy. :lotpot: No science can change their mind. All kaffirs should support them, ridicule them!

? The female circumcision, as practised in you home country, not only generally removes the entire clitoris, but also tightens the vagina by cutting the labia on opposite sides and then stitching them together at that point, so that they grow together.

This removes or diminished the ability of a woman to have an orgasm, and make sexual please for the man more intense because of the tighter opening.

However, because of this, often children have to be born by Caesarian section to avoid damage to the "graft", or the labia have to be re-attached to each other after giving birth normally.

In Western countries all of these procedures would be seen as illegal because they serve no purpose and cause harm to the woman.

One common consequence are pains when urinating, for example.

FGM serves no purpose except to give men more control over women, it is an unnecessary barbaric practice, used by men for men.

It is only Islamic because its false prophet advocated and condoned it,and he only did so because it was an already known practice within 7th century Arabian culture.

Removing the clitoral hood requires the precision of an experience surgeon, it cannot be done correctly by some religiously motivated lay person, because they are as ignorant as the scriptures they read, which tell them that this practice is necessary.

Their lack of medical knowledge will therefore lead to catastrophic consequences for the wretched child who must endue this horrific procedure, performed generally without any pain relief, which will leave her mentally and physically damaged for the rest of her life.

You as a Muslim have a blinkered view over this subject, because of what your teachings tell you, and will therefore feel no empathy whatsoever for the poor unfortunate wretch who has to undergo this violation of their body.

Civilisation tells us that anything which damages a human being to such extent cannot be good for humanity as a whole, which seemingly the false god Allah has no such concerns, and has allowed this draconian practice to continue for centuries.

Allah proves itself to be as savage as his gullible slaves, who are just a reflection of a time when human life, especially female human life was "cheap "there for the sole purpose of a mans pleasure, to be used and abused as and when, and since Islam is a faith borne within this timeframe, this mind-set is still perpetuated throughout the Islamic world today.

I am asking this because, unlike Jewish people, Muslim almost always argue health reasons for circumcision and the "procedure" carried out on women. The evidence is then on the lines "I have been circumcised, and I never had any sexually transmitted disease."

The reason for this stance is that none of these things are mentioned in the Qur'an, so the entire basis for both practices are in the hadith only. This makes Muslims uncomfortable when discussing the topic with non-Muslims. Why? Simple, if this particular issue is taken from the hadith and implemented, it makes it impossible to argue that other reports of Mohammed's actions should be ignored.

Circumcision is pretty much compulsory, but what about other things Mohammed taught, ordered and set an example for, which Muslims in general shirk away from... ?

So, to avoid the entire house of cards collapsing, they simply steer away from the focus on the hadith altogether and make a case for health reasons, which in reality does to stand up.

Do you think that Allah has made a mistake when creating the human body that his imperfection must be corrected by male and female circumcision?
its not imperfection but its indeed created to be corrected (so human have thing to be corrected) just as hair & nail!

Garudaman, I personally know 5 women who had done what I described, and I know this from account by they family.

Oh, Garudaman! The nails and hair have to be trimmed because they would otherwise grow forever and become unwieldy. If the clitoris were similar, the poor ladies would find themselves in a circus!
However, since you've mentioned it...
Nails have a function and need to grow but often grow too long if not worn by use: so trimming is reasonable. But what about hair? Maybe the first few inches could be said to have a function, but then it keeps on growing and nothing natural wears it down. Why did Allah design it to grow longer? Why trim it at all, if Allah doesn't want it to stop growing? Why remove Allah's gift of pubic and under-arm hair etc, which doesn't keep on growing anyway? Does Allah want everyone to look like pre-pubertal children? Why didn't he make people remain that way then? :clueless:
